Terms of Service
1. Agreement
By using kelybu.com you agree to these Terms. Operated by MACRODARK LLC, a Florida limited liability company (Orlando / Orange County). “Kelybu” is the product / d/b/a name. If you use Kelybu for a school, you represent you have authority to accept them for that use, or you use the service in a personal capacity. Creating an account or completing a purchase is acceptance. Browsing the marketing home alone is not.
2. Eligibility
Kelybu is made for teachers, but anyone 18 or older may use it. You must be 18 or older and able to form a binding contract. Student accounts, child accounts, and accounts for anyone under 18 are not offered and are prohibited. If we learn an account belongs to a minor, we may delete it.
3. Nature of the service
Kelybu provides educational templates and optional AI-assisted generation of supplemental classroom materials. Kelybu is not an adopted instructional material of the State of Florida or of any school district. Kelybu is not a school, not a therapist, and not a legal or IEP service. Materials are intended as age-appropriate supplemental classroom resources for the grades and subjects you select. Kelybu does not provide counseling, sexual education curricula, or ideological advocacy products.
4. AI-assisted content
Outputs may contain errors, misaligned standards, or unsuitable items. You must review every resource before using it with learners. You are responsible for classroom use, differentiation decisions, and compliance with your school’s policies.
5. Acceptable use
You will not:
- submit student personal information, education records, photos, or voice of minors
- type a student’s real name, ID, diagnosis, grades, medical notes, or IEP content into prompts
- request copyrighted characters or third-party brands you do not own
- attempt to extract model weights, resell raw model access, jailbreak the generator, or probe the system
- upload malware or scrape the service in a way that degrades it
- generate sexual content of any kind (images, text, or other), including pornography, sexualization of minors (zero tolerance), or sexual or romantic content involving children
- generate graphic violence, self-harm instructions, or weapons presented as toys for young learners
- request material that is not age-appropriate for an ordinary classroom setting for the selected grade (including sexual topics or sexual-orientation instructional content aimed at young children)
- use the service if you are under 18
We may suspend accounts for abuse. See also the Acceptable Use Policy.
6. Accounts and credits
Free allocations are limited and may change. Credits have no cash value, are non-transferable, and are not a gift card. Extra credit packs, if offered, are non-refundable once purchased, including unused credits, except where required by law. After any AI generate runs against a pack or paid period, that pack or period is used: no refund and no proration of unused credits, except where required by law. Failed generates that never reach the generator do not trigger that rule. Cache hits may not consume credits. Quality, taste, or usefulness of AI output is not a refund reason.
7. Intellectual property
- The Kelybu name, characters (elephant and penguin), site, and software are ours.
- You retain rights in original materials you later upload (marketplace, if enabled), subject to the license you grant us to host and display them.
- For AI-assisted outputs created in the service, we grant you a license to use them for your own educational purposes (your classroom or your child). Redistribution commercially may be restricted until a marketplace agreement exists.
- We may store de-identified outputs to improve templates and the library, as described in the Privacy Policy.
8. Payment (when enabled)
Prices are in USD. Taxes may be extra. All plan, add-on, and credit-pack charges are final once paid. There is no 30-day money-back guarantee, no “risk-free” trial, and no prorated refund if you cancel during a paid period. Canceling stops the next renewal where renewals exist; fees already paid are not returned. Payments are non-refundable except where the law requires a refund: (a) you were under 18; (b) we committed fraud or a material misrepresentation; (c) the charge was unauthorized or duplicated; or (d) we did not deliver the paid service (it never ran). A card-network chargeback is not a Kelybu refund. Chargebacks without a good-faith dispute, and fraud, may result in suspension.
9. Disclaimer
THE SERVICE IS PROVIDED “AS IS.” WE DISCLAIM WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW. AI OUTPUT IS NOT WARRANTED TO BE ACCURATE, COMPLETE, OR STANDARDS-ALIGNED. DO NOT USE THE GENERATOR TO CREATE SEXUAL CONTENT. AI OUTPUT IS NOT WARRANTED TO BE AGE-APPROPRIATE UNTIL YOU REVIEW IT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KELYBU’S LIABILITY ARISING OUT OF THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM, OR USD $50 IF YOU PAID NOTHING.
11. Indemnity
You will indemnify Kelybu against claims arising from your prompts, your classroom use, or your violation of these Terms.
12. Schools
If a school requires students to use any child-facing feature (not available in version 1), a separate written agreement and data privacy addendum are required before that feature is enabled.
13. Termination
You may delete your account by emailing [email protected]. We may terminate for breach or risk.
14. Governing law
Laws of the State of Florida, excluding conflict rules. Exclusive venue: state or federal courts in Orange County, Florida.
